are factories & collection be the BL or should we create another layer to do so? I see that I need to bind the ValidationLayer with the collections and/or entities, hence a separate layer for BL. But, what will that be, the EntityFactories?

Whether to do a BL or not depends upon your APP Architecture. Maybe I misunderstand your question/scenario. Could you please elaborate more on this?
